This website is operated by Daughter Judy, LLC (hereinafter “Capital Fabric Supply”). Throughout these Terms of Use, the words “we”, “us” and “our” refer to Capital Fabric Supply. By accessing or using the Capital Fabric Supply website (www.capitalfabricsupply.co, the “Platform”) on any device, you signify acceptance of all terms, conditions, policies and notices stated here. Capital Fabric Supply may modify these terms at any time. It is your responsibility to check our website periodically for changes. Your purchase of our “Product”, visiting of our Platform and engaging in our “Service” you agree to the following Terms of Use. If you do not agree to these Terms of Use, please do not use our platform or services.

Our online store is hosted by Shopify Inc. They provide us with the e-commerce platform allowing us to sell our products and services to you. These activities are governed by the Shopify Privacy Policy and Terms of Service, found here.

By agreeing to these terms you identify being of at least legal majority age in your state or province of residence or have given us consent to allow any minority dependents to use this site.

We reserve the right to refuse service to anyone for any reason at any time. If we decide to cancel or change an order we will attempt to notify you via the email / billing address / phone number provided during purchase. We reserved the right to limit or prohibit orders that we deem to appear to be placed by dealers, resellers or distributors.

You agree not to reproduce, duplicate, copy, sell or resell any portion of the Product or Service without express permission by Capital Fabric Supply. All content of patterns (including instructions, illustrations, photos) are copyright protected and belong exclusively to Daughter Judy, LLC. You may use the Product and Platform for your own personal and non-commercial use only as stated here and on physical Product.

You may not use our product for any illegal or unauthorized purpose. Breach of violation will result in immediate termination of Service.

Capital Fabric Supply has made every effort in production of its Product to create as accurate a product as possible. We reserve the right to modify, update or correct our Product as we see fit. Product descriptions and pricing are subject to change at any time without notice. We reserve the right to discontinue Product at any time.

We have made every effort to capture accurate color and images as to how the Product appears in person. We are not responsible and cannot guarantee that your personal computer monitor’s display will be accurate.

We reserve the right to limit sales of our Product and Service to any person at any time.

We do not warrant that the quality of any Product or Service obtained by you will meet your expectations, or that an error in the Service will be corrected.

SECTION 2 - ACCOUNT, PASSWORD AND BILLING
You agree to provide current, accurate and complete information for all purchases made in our store. All information should be updated by you when necessary to complete transactions and contact you as needed.

You are responsible for the confidentiality of any password created. Furthermore you are responsible for any and all activity that occurs under your account. You agree to notify Capital Fabric Supply immediately if you see any unauthorized use of your account or breach of security. Capital Fabric Supply will not be responsible for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. You will be held responsible for any losses incurred by Capital Fabric Supply or another party due to someone else using your account or password. Credit card information is always encrypted during transfer over networks. Your submission of personal information is governed by our Privacy Policy.

We reserve the right to monitor, edit or remove content we determine to be offensive, obscene, threatening, defamatory, unlawful or otherwise objectionable or that violates any party’s IP or these Terms of Use.

You agree when reviewing / commenting that you will not violate any right or any third party which includes copyrights, trademarks, privacy or other personal or proprietary right. You will also agree that your review / comments will not contain any of the above mentioned content that would result in removal. You are solely responsible for the accuracy of the review / comments you submit.

Capital Fabric Supply does not promise that your use of the platform will be uninterrupted, timely, secure or error-free or that defects will be corrected. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that all products and services delivered to you through the platform are provided “as is” and “as available” for your own use at your own risk.

Capital Fabric Supply cannot ensure that any files or other data you download from the Platform will be free of viruses or contamination or destructive features.

SECTION 8 - TERMINATION
You agree that Capital Fabric Supply may terminate access to the Platform, block or restrict your future access to the Platform and delete your profile for any reason at any time.

These terms remain in effect even after your account is terminated. You may terminate these terms at any time by contacting us if you no longer wish to use our services, or when you cease using our site.


SECTION 9 - SEVERABILITY
In the event that any provision of the Terms of Use is held to be invalid, the remainder of these Terms of Use shall continue to be enforceable to the fullest extent permitted by applicable law.

You agree that this Platform, Terms of Use, Privacy Policy and any dispute between you and Capital Fabric Supply shall be governed in all respects by the laws of New York, United States of America.
